Eligibility
You must be at least 18 years of age to use Kindex360. By using the Services, you represent that you are 18 or older and authorized to act on behalf of any business you represent.
Your Account and Responsible Use
You are responsible for the accuracy of the information you provide and for how you use the Services in connection with your business. You are responsible for complying with all applicable laws when using SMS, email, telephone, automation, and customer data through Kindex360, including any consent or notice requirements that apply to your communications and to recording or processing customer information.
Subscriptions, Plans, and Billing
Kindex360 plans are recurring monthly subscriptions. Plan pricing and one-time setup fees are listed on our pricing page.
- You may cancel your subscription at any time, and cancellation prevents future renewal.
- There is no prorated refund for the current billing period once a monthly charge has been processed.
- Monthly subscription payments are non-refundable once charged, except where a refund is required by applicable law.
- Setup fees become non-refundable once setup work has begun.
- Kindex360 does not currently offer a free trial.
Usage-Based Charges
Phone, SMS, email, AI, carrier, and other service usage may be subject to reasonable-use limits or additional usage-based charges depending on your plan, configuration, and volume. Kindex360 does not promise unlimited usage unless explicitly stated for your plan. We will be transparent about any applicable limits during onboarding.
Done-for-You Setup
Our team handles your account setup, onboarding, and configuration. Setup timelines may vary based on your business and the information you provide. You remain responsible for the accuracy of the information used to configure your account.
Artificial Intelligence and Communications
Some communications through Kindex360 may be assisted or generated by artificial intelligence, including an AI receptionist that answers calls or responds to inquiries. AI can make mistakes, and AI-assisted content should not be treated as guaranteed accurate.
Call-recording functionality may exist within the platform, but call recording is not routinely enabled by Kindex360. If you choose to enable recording, you are responsible for complying with all applicable notice and consent requirements.
Payment Processing
Where payment features are configured, payment processing is handled by third-party payment processors. Kindex360 is not a bank or a payment processor, and we do not hold funds on your behalf. Payment processing is subject to the terms of the applicable processor.
Third-Party Services
Kindex360 may rely on or integrate with third-party services and providers. Availability and performance of the Services may be affected by those third parties, and we are not responsible for their actions or outages.
No Guarantee of Results
Kindex360 provides tools to help you capture leads, automate follow-up, schedule appointments, manage communications, request reviews, and run your business. We do not guarantee any specific business results, including revenue, leads, sales, appointments, ratings, rankings, conversions, or profits. Outcomes depend on many factors, including how you use the platform and your individual business circumstances.
Intellectual Property
All content, branding, and software associated with Kindex360 are owned by Kindex360 or its licensors and may not be copied or reused without permission.
Disclaimer of Warranties and Limitation of Liability
The Services are provided on an "as is" and "as available" basis. To the extent permitted by law, Kindex360 disclaims warranties of any kind and is not liable for indirect or consequential damages arising from your use of the Services.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date.
